The New York Times’s Dave Itzkoff reported last week that, in response to a countersuit filed by the Associated Press, lawyers for the artist Shepard Fairey have asserted the Associated Press was engaging in a similar practice by claiming ownership of and licensing photographs of copyrighted works by artists, including Jeff Koons, Banksy, and Fairey, without their permission. In February, Fairey sued the Associated Press, seeking a declaratory judgment that the Hope_ poster does not infringe on the news service’s copyrights. The Associated Press countersued in March, saying that Fairey misappropriated its rights to the original image of Obama.
